Your use of this Site following any such changes constitutes your agreement to follow and be bound by the Terms and Conditions as changed. W.Lane will only collect and use your personal information as outlined below. From time to time we are required to collect, hold, use and/or disclose personal information relating to customers in the performance of its business activities. The below sets out our policy in relation to the protection of personal information, as under the Privacy Act 1998 (Cth) (the Act) and the Australian Privacy Principles (APP). The APPs regulate the handling of personal information.

The Privacy Policy applies to the services offered on the W.Lane website (WLANE.COM.AU) operated by W.Lane of the Pretty Girl Fashion Group Pty Ltd.

We may collect and process personal data relating to you by you providing such personal data by filling in forms on our site or by you contacting us. This includes, but is not limited to, information provided at the time of registering to use (or become a member of) our site, subscribing to any services (e.g. newsletters), purchasing products or requesting further services.

By using cookies

W.Lane is principally a retailer, and carries out number of facilities and functions including shops (off the street and in shopping centers), the internet, promotional material (using various forms including paper and electronic mail outs), credit and other card systems, Lay-By arrangements and reward schemes.

The type of information that we collect and hold includes your name, address, email address, contact telephone number, gender, age and your product preferences.

Sensitive information: we will only collect sensitive information where you consent to the collection of the information and the information is reasonably necessary for one or more of our company’s functions or activities. Sensitive information includes, but is not limited to, information or an opinion about racial or ethnic origin, political opinions, religious beliefs, philosophical beliefs, membership of a trade union, sexual preferences, criminal record, health information or genetic information.

How W.Lane collects and holds personal information

W.Lane must collect personal information only by lawful and fair means. We will collect personal information directly from you if it is reasonable or practicable to do so.

We may collect personal information in a number of ways, including without limitation:

a) in stores;  b) through our website;  c) through application forms;
d) by email or other written mechanisms;
e) over a telephone call;
f) in person;
g) through transactions;
h) through our website;
i) through surveillance cameras;
j) by technology that is used to support communications between us;
k) from third parties, including but not limited to:
l) from past and present employers and referees when conducting reference checks, candidates after completing an interview, clients of W.Lane and contract management            services in relation to assignments;
m) through publically available information sources (which may include telephone directories, the internet and social media sites); and
n) direct marketing database providers.

When we collect personal information about you through third parties, it will manage such information in accordance with the APPs.

Much of the personal information that we hold is stored in our database. Our database comprises of hard copy files and/or electronic files in our ordinary IT systems. These may include cloud servers or servers of third parties.

Unsolicited personal information is personal information that we receive which it did not solicit. Unless we determine that it could have collected the personal information in line with the APPs or the information is contained within a Commonwealth record, it must destroy the information to ensure it is de-identified.

Purposes for which the W.Lane collects, holds, uses and/or discloses personal information

We will collect personal information if it is reasonably necessary for one or more of its functions or activities.

The main purposes for which we may collect, hold, use and/or disclose personal information may include but are not limited to providing you with:

a) product information;
b) a better website experience;
c) special offers; and / or
d) competition entry information.

You authorise that we are to retain your personal information for the purposes outlined in clause 6.2 until such time that you direct us, using the contact details contained within clause 13 herein, that you wish for this personal information to be discarded.

We may also collect, hold, use and/or disclose personal information if you consent or if required or authorised under law.

If you do not allow us to collect all or some of the personal information we request, W.Lane may not be able to achieve its purposes.

Direct marketing

W.Lane will not send you information without your prior consent. If you agree to receive information, W.Lane may contact you via email, post or other forms of direct contact.

W.Lane may use or disclose personal information (other than sensitive information) about you for the purpose of direct marketing (for example, advising you of new goods and/or services being offered by W.Lane).

W.Lane may use or disclose sensitive information about you for the purpose of direct marketing if you have consented to the use or disclosure of the information for that purpose.

You can opt out of receiving direct marketing communications from W.Lane by contacting the Privacy Officer in writing or by following the directions contained within emails from W.Lane and unsubscribing appropriately.

Disclosure of Personal Information

We may disclose your personal information for any of the purposes for which it is was collected, as indicated under clause 6 of this policy, or where it is under a legal duty to do so.

Disclosure will usually be internally, to related entities, candidates, referees, potential and actual employers and clients of W.Lane.

W.Lane may disclose personal information to third parties such as contracted service suppliers (CSP). Examples of CSPs include, but are not limited to, financial institutions for payment processing, information technology service providers, marketing and communications agencies, printers and distributers of direct marketing material and external business advisors.

Before we disclose personal information about you to a third party, we will take steps as are reasonable in the circumstances to ensure that the third party does not breach the APPs in relation to the information.

Cross-border disclosure of personal information

W.Lane utilises the services of overseas servers, your personal information may be to overseas recipients for the purposes of cloud storage.

Access to personal information

If W.Lane holds personal information about you, you may request access to that information by putting the request in writing and sending it to the Privacy Officer. We will respond to any request within a reasonable period, and a charge may apply for giving access to the personal information.

There are certain circumstances in which W.Lane may refuse to grant you access to the personal information. In such situations we will give you written notice that sets out:

a) the reasons for the refusal; and
b) the mechanisms available to you to make a complaint.

Correction of personal information

If W.Lane holds personal information that is inaccurate, out-of-date, incomplete, irrelevant or misleading, it must take steps as are reasonable to correct the information.

If W.Lane holds personal information and you make a request in writing addressed to the Privacy Officer to correct the information, we must take steps as are reasonable to correct the information and will respond to any request within a reasonable period.

There are certain circumstances in which W.Lane may refuse to correct the personal information. In such situations we will give you written notice that sets out:

a) the reasons for the refusal; and
b) the mechanisms available to you to make a complaint.

If W.Lane corrects personal information that it has previously supplied to a third party and you request us to notify the third party of the correction, we will take such steps as are reasonable to give that notification unless impracticable or unlawful to do so.

Integrity and security of personal information

W.Lane will take such steps (if any) as are reasonable in the circumstances to ensure that the personal information that it:

a) collects is accurate, up-to-date and complete; and
b) uses or discloses is, having regard to the purpose of the use or disclose, accurate, up-to-date and complete.

W.Lane will take steps as are reasonable in the circumstances to protect the personal information from misuse, interference, loss and from unauthorised access, modification or disclosure.

If W.Lane holds personal information, it no longer needs the information for any purpose for which the information may be used or disclosed, the information is not contained in any Commonwealth record and the W.Lane is not required by law to retain the information, it will take such steps as are reasonable in the circumstances to destroy the information or to ensure it is de-identified.

Anonymity and Pseudonymity

You have the option of not identifying yourself, or using a pseudonym, when dealing with W.Lane in relation to a particular matter. This does not apply:

a) where W.Lane is required or authorised by or under an Australian law, or a court/tribunal order, to deal with individuals who have identified themselves; or
b) where it is impracticable for W.Lane to deal with individuals who have not identified themselves or who have used a pseudonym.

However, in some cases if you do not provide W.Lane with your personal information when requested, we may not be able to respond to your request or provide you with the goods or services that you are requesting.

Complaints

You have a right to complain about W.Lane ‘s handling of your personal information if you believe we have breached the APPs.

If you wish to make such a complaint to W.Lane, you should first contact the Privacy Officer in writing. Your complaint will be dealt with in accordance with our complaints procedure and we will provide a response within a reasonable period.

If you are unhappy with W.Lane response to your complaint, you may refer your complaint to the Office of the Australian Information Commissioner.

W.Lane VIP Program

W.Lane VIP Program Terms and Conditions

1. W.Lane VIP Reward Cards and member benefits are for exclusive use of the W.Lane VIP Member.

2. By joining W.Lane VIP Program, you are agreeing to receive emails from W.Lane. You can opt out of receiving emails at any time. You can either follow the unsubscribe link in the latest email you were sent from us or you can contact us and we will unsubscribe you from our database. In both instances it may take up to 5 business days for your details to be fully removed from our system. W.Lane may use your personal information to contact you from time to time and/or to send advertisements about events, products and services which we think you are likely to be interested in.

3. Our Privacy Policy (below) also forms part of these Terms and Conditions.

4. To qualify for member benefits; members must present their W. Lane VIP card with every transaction; purchases must be made in the form of cash, credit card or cheque; and season spend must be $100 or more. Refunds on purchases made using your W.lane VIP card will be deducted accordingly from your season spend.

5. The two season spend periods are 1st May to 31st October, and 1st November to 30th April.

6. A 5% rebate on season spend will be issued within six months following the close of a season spend period, provided you meet the qualifying conditions. The exact date of issue is at the discretion of W.Lane.

7. The 5% rebate will be issued to members in the form of a VIP Reward Voucher. W.Lane VIP Reward Vouchers can only be redeemed on full price purchases; cannot be used in conjunction with any other offer; cannot be redeemed for cash, and cannot be used to make a lay-by payment or the purchase of Gift Cards. Other terms and conditions may apply.

8. W.Lane VIP Reward Vouchers will not be replaced if stolen or lost.

9. W. Lane accepts no responsibility for members not receiving their W.Lane Reward Vouchers, invites or any other promotional material, if incorrect details are provided or W. Lane is not notified of any change of details. W.Lane also accepts no responsibility for late, lost or misdirected correspondence resulting from circumstances outside W.Lane control.

10. The $25 VIP welcome eVoucher can only be sent to a valid email address. This eVoucher is redeemable on your next purchase online or in store. eVoucher must be surrendered on redemption in store. Customer must be logged in to redeem voucher online. May only be redeemed once per customer and excludes Sister Brands, Ezibuy, promotions, sale items, jewellery, Gift Card and e-Gift Card purchases. Voucher must be used against a purchase greater than the voucher value of $25. Not valid on a prior purchase or existing lay-bys. Not to be used in conjunction with any other offer. While stocks last. Not redeemable for cash. Neither cash nor credit will be issued for balance if not redeemed in full. Will not be replaced if lost or stolen. 12. Our Lay-by Service is available in store and exclusive to VIP Program Members. Terms and conditions apply to our Lay-by Service and are subject to change without notice. Please refer to our latest Lay-by Service Agreement; a copy of which be obtained in store.

13. It is the member's responsibility to inform W. Lane of any changes to their personal details, or update online at wlane.com.au.

14. W.Lane reserves the right, at any time without notice, to: (a) suspend, terminate or vary the W.Lane VIP program; (b) change the terms and conditions of the W.Lane VIP program; (c) terminate any individual's membership or refuse to issue any individual any membership in its absolute discretion.

15. W.Lane and Pretty Girl Fashion Group Pty Ltd shall not be liable for any loss or damage suffered by members resulting from such suspensions, terminations, variations or changes as set out in clause 11, or arising from the W.Lane VIP Program, except for any liability which can not be excluded by law.

W.Lane VIP Program Privacy Policy

Member privacy is important to W.Lane. All data collection will be handled sensitively, securely and with proper regard for privacy. W.Lane will at all times collect personal information in a lawful and fair manner. Members may be contacted at any time using the information provided for the purposes of advertising, market research and to ensure proper functioning of the W.Lane VIP Program. Transaction Terms

The following terms and conditions (the "Transaction Terms") govern all Products (as defined below) and all Transactions (as defined below) in connection with this site (the "Site"). These Transaction Terms hereby incorporate the terms and conditions of the Terms of Use applicable to this Site. Unless we expressly provide otherwise, all Transactions, all Products and your use of such Products are subject to these Transaction Terms, which shall apply.

1. Products

All rights in any products that we make available through the Site, such as music, images, video, artwork, text and other copyrightable materials (collectively, the "Products") are owned by us, our Affiliates and/or our (or their) licensors. Subject to your compliance with the terms and conditions of these Transaction Terms and any other applicable terms and conditions imposed by us, our Affiliates and/or our licensors, you have a limited, revocable right to use those Products that you purchase or access through the Site solely for your personal, non-commercial use in accordance with the terms and conditions of these Transaction Terms and any other terms and conditions that may apply to such Products, which right you cannot transfer to others. You understand that the Site and the Products include and/or rely on a security framework using technology that protects digital information and imposes usage rules established by us, our Affiliates and our (or their) licensors, and you hereby agree to abide by such usage rules.

2. Purchases

If you wish to purchase any Products made available through the Site (each such purchase, a "Transaction"), you may be asked to supply certain information in connection with such Transaction, including without limitation your credit card number or other payment account number, your billing address, and your shipping information. BY INITIATING A TRANSACTION, YOU REPRESENT AND WARRANT THAT YOU (A) ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH US AND (B) HAVE THE LEGAL RIGHT TO USE THE PAYMENT MEANS SELECTED BY YOU. By submitting such information, you grant us the right to use such information in accordance with our Privacy Policy, including, without limitation, by providing such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgement or completion of any Transaction.

How do I use the shop?

  • Choose the relevant item that you wish to purchase and click the 'Add To Shopping Bag' button to put the item into bag.
  • You will then be taken to the 'Shopping Bag' where you can edit the items and check that everything is correct. Once you have checked your basket, click the ‘Checkout' button.
  • At this point you will be required to log in as a returning customer, log in as a VIP Program Member, register to become a new member, or proceed as a guest. As a returning customer, you can log in where your details will have been saved from previous transactions.
  • You will then enter Billing and Delivery Information, filling out the required fields as a minimum. Once all the Billing and Delivery Information has been in-putted, you will need to select a payment method. Once a payment method has been selected then fill in all of the required fields as a minimum.
  • Once all the details have been filled in you will be able to review your order plus add a gift card or promotional code.
  • Once the order has been confirmed you can click on the ‘Pay Now’ button where your payment card details will be submitted to our payment services provider for secure processing. Once your payment has been securely processed, you will receive a confirmation email of your order.

Your initiation of a Transaction represents an offer to us to make a purchase, which offer is accepted by us only when your payment method has been debited in full settlement of the Transaction. We may reject or cancel any Transaction for any reason prior to our acceptance of such Transaction.

Descriptions and images of, and references to, Products on the Site do not imply our endorsement of such Products. Except to the extent prohibited by applicable law, we reserve the right, with or without prior notice, to change such descriptions, images, and references; to limit the available quantity of any Product; to honour, or impose conditions on the honouring of, any coupon, coupon code, promotional code or other similar promotions; to bar any user from making any or all Transaction(s); to refuse to provide any user with any Product; and/or to refuse or cancel any Transaction for any reason prior to our acceptance of such Transaction pursuant to this Section 2. Price and availability of any Product offered through the Site are subject to change without notice. If applicable, Product prices on the Site will be inclusive of GST unless we expressly provide otherwise. In the event that a Product is listed at an incorrect price or with other incorrect information, we have the right to refuse or cancel any Transaction for such Product at any point prior to our acceptance of such Transaction pursuant to this Section 2. You shall pay all charges that may be incurred by you or on your behalf through the Site, at the price(s) in effect when such charges are incurred, including without limitation all shipping and handling charges. In addition, you remain responsible for any taxes (including, if applicable, GST and/or any import duties) that may be applicable to your Transaction(s).

Except to the extent applicable law provides otherwise, all sales through the Site are final, and all charges from those sales are non-refundable, except as otherwise expressly set forth in these Transaction Terms. We or our third party designees may automatically process charges against your selected payment method on the receipt page. We or our third party designees will inform you if all or any portion of your order is cancelled or if additional or different information is required to accept your order.

3. Product Delivery

Except to the extent prohibited by applicable law, we reserve the right to change Product delivery options without notice. On occasion, technical and other problems may delay or prevent delivery of a particular Product. Except to the extent that applicable law provides otherwise, your sole and exclusive remedy with respect to any Product that is not delivered within a reasonable period will be either replacement of such Product or a refund of the purchase price paid for such Product, as determined by us in our sole discretion. We will endeavour to process Transaction(s) within seventy-two (72) business hours from our receipt of payment. If we anticipate a delay in delivering a Product to you, we will seek to notify you by email of the estimated delivery date(s), and we will give you the option to continue with your order or request a full refund. If we are unable to completely fulfil your order we will notify you and give you the option to continue with the partial order or request a full refund.

4. Cancelling Your Purchase

You have a right to refund your purchase of Product(s) from the Site within twenty-one days of the date on which you received such Product(s) and receive a refund, To exercise your right to a refund, you may (i) return your Product to us using the returns form enclosed within twenty-one days of receipt of your Product(s), or (ii) return your Product(s) to your local store within twenty-one days of the date identified on the invoice docket supplied with your order.

In the event that we do not receive your returned Product(s) within thirty (30) days of the latter of (i) the date you notified us of your return and (ii) the date you received your Product(s), the deemed date of receipt will be the date of the post-mark on the packaging of your returned Product(s). We will not be responsible for the costs of such return.

5. Faulty Products

In the event that you receive a faulty Product, we recommend that you contact our customer care team on 1300 728 980 Provided that you return such faulty Product to us, we will provide you with a full refund.

We will not be liable to you for failures, defects or delays in delivery caused by:

  • Your provision of incorrect or outdated information;
  • Your mailbox being full;
  • Your failure to comply with instructions for use of the Site; or
  • Any event which is outside of our reasonable control.

6. Survival

Except for the licenses granted to you (if any) pursuant to these Transaction Terms, these Transaction Terms shall survive any termination or expiration of the Terms of Use applicable to the Site.

2. Terms of Sale

By placing an Order you are offering to purchase a product on and subject to the following terms and conditions. All Orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or forces outside of our control for which we will not be responsible.

In order to contract with W.Lane you must be over 18 years of age and possess a valid credit card issued by a bank acceptable to us. W.Lane retains the right to refuse any request made by you. If your Order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be W.Lane or may in some cases be a third party. Where a contract is made with a third party W.Lane is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an Order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit card used to place your Order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to changes.

a. Our Contract

When you place an Order, you will receive an acknowledgement e-mail confirming receipt of your Order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit card.

b. Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Site are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

c. Colours

We have done our best to display as accurately as possible the colours of the products shown on the Site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

d. Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. e. Promotional Codes

We may from time to time offer promotional codes which may apply in respect of any, or certain specified, purchases made though this Website.

f. Cancelling Your Purchase

You have a right to refund your purchase of Product(s) from the Site within twenty-one days of the date on which you received your Order and receive a refund. In the event that we do not receive your returned Order within thirty (30) days of the later of (i) the date you notified us of your return and (ii) the date you received your Order the deemed date of receipt will be the date of the post-mark on the packaging of your returned Order. We will not be responsible for the costs of such return.

g. Faulty Products

In the event that you receive a faulty Product, we recommend that you contact Customer Care at customercare@wlane.com.au. Provided that you return such faulty Product to us, we will provide you with a full refund to your original payment method.
