Unless we expressly provide otherwise, all Transactions, all Products and your use of such Products are subject to these Terms, which shall apply regardless of how you access the Site. Although you may "bookmark" a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to the terms. We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Your use of this Site following any such changes constitutes your agreement to follow and be bound by the Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Site.

 

1. Privacy Policy

We do everything we can to maintain that trust. Our team are employed on the basis that they will protect information about you. Your rights to privacy are also protected by the Australian Privacy Principles in force under the Privacy Act 1988 (Cth). These privacy laws place strict requirements on us to treat certain information collected as confidential, to store your information securely and to allow you easy access to check and correct your information.

Scope of our Privacy policy

Our Privacy Policy applies to the personal information we collect, store, maintain and use about you as our customers, visitors to our website, social media pages and other digital services (“Online Services”), or stores and members of the public. Our Privacy Policy applies to all of the brands owned by us from time to time, including, but not limited to, Millers, Autograph, Rivers, Crossroads, Katies, Noni B, Rockmans, Beme and W.Lane (“Our Brands”). Personal information we collect from job applicants as part of our recruitment process is governed by our Privacy Statement.

By using Our Services (as defined below), you agree to this Privacy Policy and consent to the collection and use of information by us in accordance with this Privacy Policy. Please note that we reserve our right to amend, remove or vary this policy from time to time without notice. When do we collect information about you?

At times, we collect personal information in the normal course of providing services for our customers. These services apply to our services in-store and online across Our Brands (together “Our Services”) and include:

• Loyalty programs, membership accounts or newsletter subscriptions

• Processing lay-by purchases

• Accepting customer orders

• Processing online purchases and payments

• Registering an online account

• Customer Service lines (including social media channels such as Facebook and Instagram)

• Processing payments

• Providing tailoring instructions

Some of our Related Entities with whom we share personal information may be located overseas.

We may also disclose information to third party service providers or contractors. The countries this information may be disclosed to will vary from time to time, but may include Australia, New Zealand, South Africa, the United States of America, Israel and the European Union.

Sometimes we use third party platforms and services to process sales, store and analyse data and information, provide web support, send marketing messages, deliver products or information or to otherwise achieve the purpose for which the information was collected. These services are hosted and managed by organisations other than ourselves, and some of these services are hosted overseas. We use products and services maintained in Australia, New Zealand and the European Union.

Your personal information may be stored in overseas (e.g. in data storage and cloud computing facilities operated by us (or by third parties on our behalf).We will take all reasonable steps to ensure recipients of this information do not breach Australian or New Zealand Privacy laws in relation to the personal information we disclose.

Where applicable information is shared with these third parties, we will take all reasonable steps to ensure that third parties observe the confidential nature of such information and are prohibited from using any or all of this information other than for the purpose for which it was provided. We will also disclose information to a law enforcement agency if we are requested to do so by that agency in relation to suspected unlawful activity.

We WILL NOT sell or trade your personal information to third parties for marketing purposes.

Promotional communications

From time to time we may use your personal information to provide you with information about our services or the services of our Associated Entities or promotional partners. We want to communicate with you only if you want to hear from us. If you prefer not to receive promotional information from us, please let us know by clicking on the “unsubscribe link”/”update your preferences” at the bottom of any of our communications, or by clicking into your account to manage the level of communication.. Once you have told us you no longer wish to receive information about Our Services, we will no longer contact you. We will keep your basic details on our ‘do not contact’ database so that we do not contact you again.

By providing your personal information to one of Our Brands, you agree that this information will be shared across Our Brands in the normal course of providing our services to you. Personal information access

You may review or change personal information related to your use of Our Services. To access your information, simply sign into your account and click on your name on the top navigational menu - this will take you to "My Profile". If you would like to know what information we hold about you please contact our Privacy Manager on privacy@mosaicbrandsltd.com.au .

We will try to ensure that all information we collect, use or disclose about you in accordance with this Privacy Policy is accurate, complete and up-to-date. We expect that you will promptly notify us of any changes to your personal information.

If you hold multiple accounts with us through any of Our Brands’ loyalty programs, we may combine your accounts to create one profile. Prior to doing this, we will take reasonable measures to ensure we have verified your membership details and that all the accounts belong to you.

If you discover that there is an error or information is missing, you can update your details online by signing in and visiting “My Profile” and editing the relevant details. Alternatively, if you wish to access or correct any personal information we hold about you, please contact our Privacy Manager on privacy@mosaicbrandsltd.com.au.

Anonymity

You have the option of using a pseudonym when dealing with us so as not to identify yourself fully to us. Please bear in mind, however, that we will be unable to provide certain services to you unless you disclose your correct identity.

If you are a candidate for employment you must provide personal information which is in all respects true, accurate and up to date and is not, in any respect, misleading, deceptive or inaccurate or likely to be misleading or deceptive.

Security

We understand the importance of your personal information and have appropriate procedures in place to safeguard and secure the information we collect to prevent unauthorised access or disclosure, maintain data accuracy and ensure the appropriate use of information. We also take measures in respect of destroying or de-identifying personal information that is no longer needed for any lawful purpose.

We take website and credit card security extremely seriously and always endeavour to provide a secure, safe platform from which to conduct online transactions. We use the industry standard Secure Sockets Layer (SSL) protocol, which encrypts information as it is transmitted over the internet. This encryption scrambles details such as credit card numbers, billing details and delivery addresses so that other computers are unable to decipher the information, ensuring privacy and security.

All such enquiries or complaints will be taken seriously and handled with impartiality and discretion.

If you wish to submit a complaint or concern, please provide us with all relevant details such as the date and time of the incident or communication, the circumstances surrounding the event and your concerns about what was said or done. You will also receive an acknowledgment from us within 7 days confirming receipt of your issue.

Once your complaint/concern has been submitted to us, we will assess whether or not it is governed by the relevant privacy laws. If it is not something appropriately dealt with under privacy law we will write to you and explain why our Privacy Manager is unable to address your issue.

If your complaint/concern relates to the relevant privacy laws cover, we will thoroughly investigate all aspects of your complaint including ascertaining the relevant facts and what your expectations are for any resolution. During our investigation we may need to seek further information from you as to the nature of or factual circumstances surrounding your issue.

We will endeavour to respond to you at all times promptly and to offer a practical solution which is consistent with our legal obligations.

W.Lane VIP Program

W.Lane VIP Program Terms and Conditions

1. W.Lane VIP Reward Cards and member benefits are for exclusive use of the W.Lane VIP Member.

2. By joining W.Lane VIP Program, you are agreeing to receive emails and text messages from W.Lane. You can opt out of receiving emails or text messages at any time by following the unsubscribe link in the latest email or text message you received which directs you to our preference centre, reply STOP to the text message or email you received from us. Alternatively you can contact us on 1300 728 980 and we will opt you out of future text messages and emails. In both instances it may take up to 5 business days for your preference to be updated on our system. Unless you choose to opt out for longer the duration of the opt out will be for 3 months. W.Lane may use your personal information to contact you from time to time and/or to send advertisements about events, products and services which we think you are likely to be interested in.

3. Our Privacy Policy (below) also forms part of these Terms and Conditions.

4. To qualify for member benefits; members must present their W. Lane VIP card with every transaction; purchases must be made in the form of cash, credit card or cheque; and season spend must be $100 or more. Refunds on purchases made using your W.lane VIP card will be deducted accordingly from your season spend.

5. The two season spend periods are 1st May to 31st October, and 1st November to 30th April.

6. A 5% rebate on season spend will be issued within six months following the close of a season spend period, provided you meet the qualifying conditions. The exact date of issue is at the discretion of W.Lane.

7. The 5% rebate will be issued to members in the form of a VIP Reward Voucher. W.Lane VIP Reward Vouchers can only be redeemed on full price purchases; cannot be used in conjunction with any other offer; cannot be redeemed for cash, and cannot be used to make a lay-by payment or the purchase of Gift Cards. Neither cash nor credit will be issued for balance if not redeemed in full. Will not be replaced if lost or stolen. Other terms and conditions may apply.

8. W.Lane VIP Reward Vouchers will not be replaced if stolen or lost.

9. W. Lane accepts no responsibility for members not receiving their W.Lane Reward Vouchers, invites or any other promotional material, if incorrect details are provided or W. Lane is not notified of any change of details. W.Lane also accepts no responsibility for late, lost or misdirected correspondence resulting from circumstances outside W.Lane control.

10. The VIP welcome eVoucher can only be sent to a valid email address. This eVoucher is redeemable on your next purchase online or in store. eVoucher must be surrendered on redemption in store. Customer must be logged in to redeem voucher online. May only be redeemed once per customer and excludes Sister Brand & EziBuy products, promotions, sale items, jewellery, Gift Card and e-Gift Card purchases. Not valid on a prior purchase or existing lay-bys. Not to be used in conjunction with any other offer. While stocks last. Not redeemable for cash. 11. The VIP birthday eVoucher can only be sent to a valid email address. This eVoucher is redeemable on your next purchase online or in store. eVoucher must be surrendered on redemption in store. Customer must be logged in to redeem voucher online. May only be redeemed once per customer and excludes accessories, by Fairfax & Roberts, Barcs, Sister Brands, Sonsee, Milleni, Timex, Rosefield, Pumpkin Patch and EziBuy items, promotions, sale items, jewellery, Gift Card and e-Gift Card purchases. Not valid on a prior purchase or existing lay-bys. Not to be used in conjunction with any other offer. While stocks last. Not redeemable for cash. 12. Our Lay-by Service is available in store and exclusive to VIP Program Members. Terms and conditions apply to our Lay-by Service and are subject to change without notice. Please refer to our latest Lay-by Service Agreement; a copy of which be obtained in store.

13. It is the member's responsibility to inform W. Lane of any changes to their personal details, or update online at wlane.com.au.

14. W.Lane reserves the right, at any time without notice, to: (a) suspend, terminate or vary the W.Lane VIP program; (b) change the terms and conditions of the W.Lane VIP program; (c) terminate any individual's membership or refuse to issue any individual any membership in its absolute discretion.

15. W.Lane and Mosaic Brands LTD shall not be liable for any loss or damage suffered by members resulting from such suspensions, terminations, variations or changes as set out in clause 11, or arising from the W.Lane VIP Program, except for any liability which can not be excluded by law.

Transaction Terms

The following terms and conditions (the "Transaction Terms") govern all Products (as defined below) and all Transactions (as defined below) in connection with this site (the "Site"). These Transaction Terms hereby incorporate the terms and conditions of the Terms of Use applicable to this Site. Unless we expressly provide otherwise, all Transactions, all Products and your use of such Products are subject to these Transaction Terms, which shall apply.

1. Products

All rights in any products that we make available through the Site, such as music, images, video, artwork, text and other copyrightable materials (collectively, the "Products") are owned by us, our Affiliates and/or our (or their) licensors. Subject to your compliance with the terms and conditions of these Transaction Terms and any other applicable terms and conditions imposed by us, our Affiliates and/or our licensors, you have a limited, revocable right to use those Products that you purchase or access through the Site solely for your personal, non-commercial use in accordance with the terms and conditions of these Transaction Terms and any other terms and conditions that may apply to such Products, which right you cannot transfer to others. You understand that the Site and the Products include and/or rely on a security framework using technology that protects digital information and imposes usage rules established by us, our Affiliates and our (or their) licensors, and you hereby agree to abide by such usage rules.

2. Purchases

If you wish to purchase any Products made available through the Site (each such purchase, a "Transaction"), you may be asked to supply certain information in connection with such Transaction, including without limitation your credit card number or other payment account number, your billing address, and your shipping information. BY INITIATING A TRANSACTION, YOU REPRESENT AND WARRANT THAT YOU (A) ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH US AND (B) HAVE THE LEGAL RIGHT TO USE THE PAYMENT MEANS SELECTED BY YOU. By submitting such information, you grant us the right to use such information in accordance with our Privacy Policy, including, without limitation, by providing such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgement or completion of any Transaction.

How do I use the shop?

  • Choose the relevant item that you wish to purchase and click the 'Add To Shopping Bag' button to put the item into bag.
  • You will then be taken to the 'Shopping Bag' where you can edit the items and check that everything is correct. Once you have checked your basket, click the ‘Checkout' button.
  • At this point you will be required to log in as a returning customer, log in as a VIP Program Member, register to become a new member, or proceed as a guest. As a returning customer, you can log in where your details will have been saved from previous transactions.
  • You will then enter Billing and Delivery Information, filling out the required fields as a minimum. Once all the Billing and Delivery Information has been in-putted, you will need to select a payment method. Once a payment method has been selected then fill in all of the required fields as a minimum.
  • Once all the details have been filled in you will be able to review your order plus add a gift card or promotional code.
  • Once the order has been confirmed you can click on the ‘Pay Now’ button where your payment card details will be submitted to our payment services provider for secure processing. Once your payment has been securely processed, you will receive a confirmation email of your order.

Your initiation of a Transaction represents an offer to us to make a purchase, which offer is accepted by us only when your payment method has been debited in full settlement of the Transaction. We may reject or cancel any Transaction for any reason prior to our acceptance of such Transaction.

Descriptions and images of, and references to, Products on the Site do not imply our endorsement of such Products. Except to the extent prohibited by applicable law, we reserve the right, with or without prior notice, to change such descriptions, images, and references; to limit the available quantity of any Product; to honour, or impose conditions on the honouring of, any coupon, coupon code, promotional code or other similar promotions; to bar any user from making any or all Transaction(s); to refuse to provide any user with any Product; and/or to refuse or cancel any Transaction for any reason prior to our acceptance of such Transaction pursuant to this Section 2. Price and availability of any Product offered through the Site are subject to change without notice. If applicable, Product prices on the Site will be inclusive of GST unless we expressly provide otherwise. In the event that a Product is listed at an incorrect price or with other incorrect information, we have the right to refuse or cancel any Transaction for such Product at any point prior to our acceptance of such Transaction pursuant to this Section 2. You shall pay all charges that may be incurred by you or on your behalf through the Site, at the price(s) in effect when such charges are incurred, including without limitation all shipping and handling charges. In addition, you remain responsible for any taxes (including, if applicable, GST and/or any import duties) that may be applicable to your Transaction(s).

Except to the extent applicable law provides otherwise, all sales through the Site are final, and all charges from those sales are non-refundable, except as otherwise expressly set forth in these Transaction Terms. We or our third party designees may automatically process charges against your selected payment method on the receipt page. We or our third party designees will inform you if all or any portion of your order is cancelled or if additional or different information is required to accept your order.

3. Product Delivery

Except to the extent prohibited by applicable law, we reserve the right to change Product delivery options without notice. On occasion, technical and other problems may delay or prevent delivery of a particular Product. Except to the extent that applicable law provides otherwise, your sole and exclusive remedy with respect to any Product that is not delivered within a reasonable period will be either replacement of such Product or a refund of the purchase price paid for such Product, as determined by us in our sole discretion. We will endeavour to process Transaction(s) within seventy-two (72) business hours from our receipt of payment. If we anticipate a delay in delivering a Product to you, we will seek to notify you by email of the estimated delivery date(s), and we will give you the option to continue with your order or request a full refund. If we are unable to completely fulfil your order we will notify you and give you the option to continue with the partial order or request a full refund.

4. Cancelling Your Purchase

You have a right to refund your purchase of Product(s) from the Site within twenty-one days of the date on which you received such Product(s) and receive a refund, To exercise your right to a refund, you may (i) return your Product to us using the returns form enclosed within twenty-one days of receipt of your Product(s), or (ii) return your Product(s) to your local store within twenty-one days of the date identified on the invoice docket supplied with your order.

In the event that we do not receive your returned Product(s) within thirty (30) days of the latter of (i) the date you notified us of your return and (ii) the date you received your Product(s), the deemed date of receipt will be the date of the post-mark on the packaging of your returned Product(s). We will not be responsible for the costs of such return.

5. Faulty Products

In the event that you receive a faulty Product, we recommend that you contact our customer care team on 1300 728 980 Provided that you return such faulty Product to us, we will provide you with a full refund.

We will not be liable to you for failures, defects or delays in delivery caused by:

  • Your provision of incorrect or outdated information;
  • Your mailbox being full;
  • Your failure to comply with instructions for use of the Site; or
  • Any event which is outside of our reasonable control.

6. Survival

Except for the licenses granted to you (if any) pursuant to these Transaction Terms, these Transaction Terms shall survive any termination or expiration of the Terms of Use applicable to the Site.

2. Terms of Sale

By placing an Order you are offering to purchase a product on and subject to the following terms and conditions. All Orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or forces outside of our control for which we will not be responsible.

In order to contract with W.Lane you must be over 18 years of age and possess a valid credit card issued by a bank acceptable to us. W.Lane retains the right to refuse any request made by you. If your Order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be W.Lane or may in some cases be a third party. Where a contract is made with a third party W.Lane is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an Order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit card used to place your Order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to changes.

a. Our Contract

When you place an Order, you will receive an acknowledgement e-mail confirming receipt of your Order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit card.

b. Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Site are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

d. Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

e. Promotional Codes

We may from time to time offer promotional codes which may apply in respect of any, or certain specified, purchases made though this Website.

The conditions of use relating to any promotional code will be specified at the time of issue.

f. Cancelling Your Purchase

You have a right to refund your purchase of Product(s) from the Site within twenty-one days of the date on which you received your Order and receive a refund. To exercise your right to a refund, you may (i) notify us at customercare@wlane.com.au within twenty-one days of receipt of your Order, or (ii) return your Order to your local store within twenty-one days of receipt of your Order:

In the event that we do not receive your returned Order within thirty (30) days of the later of (i) the date you notified us of your return and (ii) the date you received your Order the deemed date of receipt will be the date of the post-mark on the packaging of your returned Order. We will not be responsible for the costs of such return.

g. Faulty Products

In the event that you receive a faulty Product, we recommend that you contact Customer Care at customercare@wlane.com.au. Provided that you return such faulty Product to us, we will provide you with a full refund to your original payment method.

We will not be liable to you for failures, defects or delays in delivery caused by:

  • Your mailbox being full;
